Mother of accused kidnapper made witness, visitation denied

The mother of an 18-year-old woman accused of kidnapping a businessman's son has been made a witness in the case, leading to an official denial of a visit with her daughter, her lawyer reports.

The mother of 18-year-old Adelina Batyrova from Surgut has been designated a witness in the case of the «kidnapping» of a Krasnoyarsk businessman«s son. Because of this, she is being denied a visit with her daughter, NGS24.RU reported, citing Ramia Batyrova»s lawyer, Andrei Dyachenko.

According to the lawyer, on 3 February they received an official refusal for a visit.

«The investigator justified this by saying that Adelina might allegedly convey information about some items and documents significant for the case, and my client might try to »conceal« such information,» Dyachenko explained. «Moreover, the ruling also references my client»s status as a witness in the criminal case, which in itself, according to the investigation, makes the visit impossible.«

Ramia Batyrova«s representative disagrees with these arguments and considers them »far-fetched.« Andrei Dyachenko says that the Federal Penitentiary Service (GUFSIN) staff monitor visits, »which rules out even the potential possibility of passing any «significant information on the case.»«

«The witness status of Adelina»s mother is formal because she gave testimony solely regarding her daughter«s character, not on the factual circumstances of the case, which she does not know. But, unfortunately, the permission for visits with relatives during the investigation under current legislation is entirely at the discretion of the investigator, which leads to such refusals without any specifics,» said Dyachenko.

They will try to appeal the investigator«s decision.

At the end of January, Ramia Batyrova flew to Krasnoyarsk and recorded a video appeal saying that she is not allowed to see her daughter and that the girl needs an operation after a car accident.

Adelina Batyrova is accused of fraud in the case of the «kidnapping» of the 14-year-old son of major businessman Andrei Kapli. On the evening of 22 January, the boy left the cottage village Serebryany Bor with Adelina, who was a stranger to him. They broke into home safes and took 2.5 million rubles (about $27,000 at current rates) from them.

The girl then handed the money over to an unfamiliar man near the restaurant «Sever,» keeping 31,000 rubles (about $340 at current rates) for herself. The «courier» was detained on 2 February in Blagoveshchensk — he turned out to be a 22-year-old resident of the Tyumen region.

The boy«s father was demanded 30 million rubles (about $327,000 at current rates) as a ransom. Adelina and the boy went to a rented apartment on Krasrab, where they waited for further instructions. They were found there on the evening of 23 January.

As it turned out, the boy was threatened by fraudsters who forced him to take the money and stage the kidnapping. The boy told investigators that the fraudsters introduced themselves as law enforcement officers, and he himself thought he was helping his father. Adelina Batyrova also claims that she became a victim, but she was detained as an accomplice and placed in a pre-trial detention center (SIZO).
