Yaroslavl to Auction Land for Private Educational Facility

The Yaroslavl city administration is auctioning a land plot zoned for education, saying a municipal school or kindergarten cannot be built there.

The Yaroslavl city administration has put up for auction a site for the construction of a private children«s institution. The plot is located in the Krasnoperekopsky district between Naumova, Fabrichnaya, and Bolshaya Pavlovskaya streets. According to the Yaroslavl Land Use and Development Rules, the site is in a zone for children»s educational organizations, and its specific permitted use is «preschool, primary, and secondary general education».
The development plot is highlighted in purple on the cadastral map.

We asked the city administration why they are not building a kindergarten or school on the site themselves and instead plan to transfer the right to a private developer.
The city administration explained that the site was included in the zone for children«s educational organizations back in 2009, but it was never added to the list of addresses for planned municipal children»s institutions.
«The area, configuration, and location features of the site do not allow for the placement of a municipal children»s educational organization in accordance with current design standards and technical regulations,« the city administration told 76.RU.
However, the site can be used for the construction of a supplementary education institution or an educational organization for children with disabilities. It is for these purposes that the authorities plan to lease the land.
A second question is whether a private developer, having obtained the right to build on this site, might erect a high-rise building or shopping center instead of the promised children«s institution.
The city administration assures this is impossible. They cited the Russian Land Code, which stipulates that when a lease agreement for a municipal or state plot is concluded as a result of an auction, the type of land use cannot be changed.
Recall that the auction for the right to lease the plot is scheduled for February 11. The starting price for the right to lease this land is 899,300 rubles (annual rent; approximately $9,900 at current rates).
