The prosecutor«s office of the Kurchatovsky district of Chelyabinsk reviewed a complaint from a former employee of Socher LLC regarding a violation of labor rights. It was found that during his employment, the employer on its own initiative fully deprived him of his bonus for two months — totaling over 40,000 rubles (approx. $400).
Under the law, an employer has the right to determine the grounds and amount of bonuses, but a decision to withhold payment must be based on local regulations, taking into account the quality of work of the specific employee and his contribution to the organization«s activities. Contrary to the requirements of Article 135 of the Labor Code of the Russian Federation, Socher LLC had not developed such regulations establishing a bonus system.
The prosecutor«s office deemed the bonus deprivation unlawful and inconsistent with the fundamental principles of legal regulation of labor relations. A representation was submitted to the head of the organization. After its review, the violations were remedied: the former employee received the bonus in full.
