A resident of Syumsinsky District (Udmurt Republic, Russia) contacted the prosecutor«s office with a complaint about a violation of her social rights. The supervisory authority conducted an investigation and found that the reason for denying the benefit was a requirement to provide a court decision on the minor»s place of residence. The applicant«s marriage to the child»s father had been dissolved.
During the investigation, it was established that the minor was registered at the mother«s address and that there was no dispute between the parents regarding his residence. Thus, additional documents were not required to receive the benefit.
The district prosecutor«s office filed a lawsuit demanding the appointment and payment of the lump-sum benefit, as well as compensation for moral harm. The court fully granted the claim.
Enforcement of the court decision remains under the prosecutor«s office»s supervision.
