Bailiff Attempts to Sue Woman for 70,000 Rubles Over Social Media Video

In the Voronezh Region, a bailiff attempted to sue a woman for 70,000 rubles (approximately 778 USD at current rates) for publishing a video with him on social media. However, nothing came of it. This was reported on January 27 by the Anninsky District Court.
In September of last year, the bailiff, along with a colleague, arrived at one of the residents of Anna to execute a court order. On the spot, they handed over the order to the person who was to be taken into custody. The events were filmed by M. — the wife of the person the bailiffs visited.
Later, M. published the recording on Odnoklassniki (a Russian social network) — something about the bailiffs« behavior outraged her. One of the protagonists of the video, through the court, demanded that the woman remove the clip, as it caused the bailiff discomfort and also »moral suffering from excessive attention to his person by the residents of Anna«. As compensation for moral damages, the man demanded 70,000 rubles (approximately 778 USD).
In court, M. stated that she did not consider herself guilty, as the video she filmed had no relation to the bailiff«s private life or family.
The court examined the arguments of both sides and sided with the woman, as she filmed the video not to invade anyone«s private life or to profit. The reason for her actions was the assumption that her husband»s rights were being violated.
«Moreover, the filming by the defendant was conducted in a place open to free access, and the plaintiff is not the main subject of use, which also serves as grounds for posting the video without his consent,» the court clarified.
The court left the bailiff«s claims unfulfilled.
