On 20 April 2026, the Oktyabrsky District Court of Izhevsk found the former general director of OOO Rosagrokorporatsiya not guilty and acquitted him due to the absence of a crime. The court of first instance also recognized his right to rehabilitation.
The defendant was charged under several articles:
- attempted fraud committed using official position on an especially large scale (Part 3 of Article 30, Part 4 of Article 159 of the Criminal Code of the Russian Federation);
- falsification of evidence in a civil case (Part 1 of Article 303 of the Criminal Code);
- forgery of an official document, its storage and use to facilitate the commission of another crime (Part 4 of Article 327 of the Criminal Code).
According to the investigation, the executive entered into sham transactions for the purchase of non-metallic materials, without intending to create legal consequences. He then assigned the right to claim payment to himself as an individual entrepreneur. To do this, fictitious supply and assignment agreements were signed, after which the accused filed a lawsuit with the Arbitration Court of the Republic of Tatarstan to recover from OOO Rosagrokorporatsiya the principal debt and interest totaling 51,197,678 rubles. The crime was not completed because a company participant identified the unlawful actions and reported them to the Investigative Department of the Investigative Committee for the Republic of Tatarstan.
The court of first instance, acquitting the defendant, indicated that the totality of evidence confirms the reality of the concluded supply and assignment agreements. Partial debt under them was recognized as valid, so the entrepreneur had the right to apply to the arbitration court. Violations of procedural norms during the preliminary investigation were also noted.
The Deputy Prosecutor of the Agryzsky District of the Republic of Tatarstan filed an appeal, insisting on the reversal of the verdict due to the inconsistency of the court«s conclusions with the actual circumstances of the case. The representative of the victim – OOO Rosagrokorporatsiya – and the defense considered the verdict lawful and asked to leave it in force.
The Supreme Court of the Udmurt Republic, after studying the appeal, concluded that the court«s findings do not correspond to the actual circumstances, and the verdict was passed with significant violations of criminal procedure law. As a result, the acquittal was overturned, and the case was sent for a new trial to the same court but with a different panel.
