Mobilized Man's Family Wins Compensation After His Death En Route to War

A court has ruled in favor of the family of a mobilized soldier from Kemerovo Oblast who died while traveling to the war in 2022, after authorities denied them death benefits.

The family of a mobilized man from Kemerovo Oblast has secured compensation payments following his death en route to the war in 2022. The regional Ministry of Social Protection argued that the family was not entitled to assistance because the Kuzbass resident did not die in combat, according to a ruling by the Supreme Court of Russia, a copy of which is available to NGS42.RU.

The ruling states that in 2022, the mobilized man was sent for training prior to deployment. He and other servicemen were housed in a canvas tent where they lived for three months, despite temperatures dropping to -40°C (-40°F). As a result, the Kuzbass resident contracted pneumonia and died while traveling to the war.

The mobilized man«s mother, wife, and daughter had expected to receive death benefits but were denied.

‘The Ministry of Social Protection of Kuzbass refused to grant assistance, arguing that the applicants did not provide a document confirming the man«s death in the special military operation,’ the document states.

The man«s relatives filed a lawsuit in the Mezhdurechensk court, which recognized the need for payments, but the appellate and cassation courts did not uphold the decision, citing the conclusion of a medical commission. According to their findings, the mobilized man died not from a ‘military injury’ but during the ‘period of military service.’

Ultimately, after nearly three years of hearings, the court ordered all due payments to be made. The ruling states that the appellate and cassation courts misinterpreted the legal status of servicemen subject to partial mobilization.
