The sister of a man from Transbaikalia who died in the special military operation (SMO) will have to pay for a crime he committed before signing his contract — the man dug up a grave and desecrated a body. This was reported on 3 February on the website of the Nerchensk District Court of Transbaikalia.
A resident of the city of Nerchinsk (Zabaykalsky Krai) filed a civil suit with the court. In June 2024, a man dug up the grave of his grandfather. He broke the headstone and brought to the surface fragments of bones and clothing of the deceased. Later, a magistrate«s court found the intruder guilty under Part 1 of Article 244 of the Criminal Code of the Russian Federation.
The grandson then went to court seeking compensation for material damage and 100,000 rubles (about $1,100 at current rates) in moral damages for the insult to the memory of a close relative and the desecration of the remains.
The plaintiff had to restore the burial site himself, buying and installing a new headstone. The defendant did not voluntarily compensate for the material damage and signed a contract with the Ministry of Defense of the Russian Federation, then took part in the special military operation, during which he died.
The court established that the deceased defendant«s heir was his sister. Therefore, she became the defendant in the civil case. She acknowledged the claims, and the court granted the suit. Compensation for material and moral damages will be recovered from the deceased man»s estate.
