Kemerovo man fights builder over leaking ceiling in new apartment

According to the buyer, problems with the new expensive apartment started immediately
A resident of Kemerovo has been unable to get roof repairs for three years in a new residential complex on FPK. As the homeowner said on Monday, January 26, the ceiling in his apartment has been leaking since the building was handed over.
Yevgeny bought a shell-and-core apartment in the new building with a mortgage in 2023. He noticed the problem during the handover. Then representatives of the developer GC «Atmosfera» said they had three months to fix the issues.
Yevgeny was explained that during construction, snow got into the roof structure and it is now «coming out» through his ceiling. To fix the situation, aerators were installed on the roof—special ventilation structures that remove moisture, vapor, and condensation.
This measure did not solve the problem, and the ceiling in the new apartment in the «Parkovy» residential complex continues to leak regularly.
The owner of the ill-fated apartment filed a lawsuit. The proceedings have been ongoing for three years.
We reached out to the developer for comment. A company representative explained that a court case is currently underway and a new expert examination is being conducted. The previous one showed that the roof leak could have been caused by an improperly installed ventilation system.
‘If the examination and the repeated court determine that the developer must fix this, we, we will certainly fix it,’ Atmosfera said.
As Yevgeny explained, he did indeed install the ventilation himself.
‘The list of violations states that it is made of plastic and this is a fire hazard, but the leak problem isn«t about that. It also says that I didn»t make it a straight line but with turns. But we don«t live in a train car! Then the expert determined that there are no check valves. Although they are there. Moreover, if streams of water are flowing from my ceiling due to ventilation, what kind of humidity should I have in my apartment?’ the Kemerovo resident exclaims.
Earlier we reported that the Investigative Committee found about 10 apartments and approximately 20 plots in southern regions of Russia owned by the deputy general director of the construction company «Atmosfera» and former head of the urban development department of Kemerovo, Alexander Zvarygin. The case at the end of 2025 went to court.
