Lawmakers seek changes to disabled transport parking fines

At the 74th session of the Legislative Assembly of Krasnodar Krai, the deputies adopted an appeal to the Chairman of the State Duma of the Russian Federation Vyacheslav Volodin on the issue of improving federal legislation on social protection of disabled persons and on administrative offenses in the part of realizing the rights of drivers of cars equipped with the «Disabled» identification badge.
As noted by the Deputy Chairman of the Legislative Assembly of Krasnodar Krai and Chairman of the Committee on Healthcare and Social Protection of the Population Nikolai Petropavlovsky, the deputies in the appeal ask to consider the possibility of initiating amendments to federal legislation on social protection of disabled persons and on administrative offenses that would exclude bringing to administrative responsibility bona fide drivers of vehicles equipped with the «Disabled» identification badge, information about which is entered into the state information system «Unified Centralized Digital Platform in the Social Sphere».
The issue has become ripe because currently, if a driver used a car equipped with such an identification badge and information about which is placed in this information system to transport a disabled person, left it in a parking lot, then assisted the passenger and returned to the car left in a disabled parking spot, then his actions may be detected and qualified by authorized officials as an administrative offense. The responsibility for committing it is a fine of 5,000 rubles (about $83 at current rates).
Commenting on the adopted decision, the Chairman of the Legislative Assembly of Krasnodar Krai Yury Burlachko noted the relevance of improving legal regulation in the sphere of transportation of disabled persons.
«Currently, there is a certain paradox in the legal field: a driver providing a person with disabilities a transportation service in a car equipped with the special »Disabled« badge and entered into the state information system »Unified Centralized Digital Platform in the Social Sphere« remains under the protection of the law as long as he has a passenger of the corresponding category in the cabin. In all other cases, the carrier may be fined for parking in a disabled parking spot and directly for the identification badge installed on the car. Therefore, improving federal legislation will allow avoiding such situations in the future and generally increase the effectiveness of implementing social policy for disabled persons,» believes Yury Burlachko.
