Deputies Propose Granting Legislative Initiative to Regional Audit Chamber

Deputies of the regional Legislative Assembly have adopted amendments to the region«s Charter in the first reading. The document was presented to colleagues by Andrey Gorbany, chairman of the ZSK committee on legality, law and order, and legal protection of citizens.

Thus, the bill proposes to replace the term «issues of local significance» with «issues of direct provision of life activities of the population (issues of local significance)», and the term «representative body of local self-government» — with «representative body of the municipal formation».

Also, the draft law specifies the procedure for the governor of the krai and the acting governor to submit information on income and expenses, property and property obligations. Corresponding changes, analogous to the federal law «On General Principles of Organization of Public Power in Subjects of the Russian Federation», are being introduced into Articles 40 and 41 of the Charter of Krasnodar Krai.

In addition, the bill proposes to clarify that resolutions and orders are issued by the governor of the krai within the competence of the highest official of the region and the highest executive body of the krai — the administration of Krasnodar Krai, and in cases determined by the governor, the krai administration, represented by officials authorized by the governor, issues orders. Corresponding changes are being introduced into Articles 40¹ and 43 of the Charter.

Taking into account the experience of some legislative bodies of subjects of the Russian Federation that have granted the right of legislative initiative to audit chambers of their regions, the bill proposes to grant the Audit Chamber of Krasnodar Krai the right of legislative initiative in the Legislative Assembly of the krai.

Besides, the Charter is supplemented with Article 4¹, establishing that the federal territory «Sirius» is created and functions on the territory of Krasnodar Krai.

Yuri Burlachko, chairman of the Kuban parliament, emphasized, in particular, the significance of granting the right of legislative initiative to the regional Audit Chamber, with which the Legislative Assembly of the krai has established close interaction.

«Federal legislation is constantly being improved, legal regulation in the sphere of local self-government — an important institution in the system of public power — is changing. Undoubtedly, all this is promptly reflected in the Charter of the krai. The current adjustments to its individual provisions are confirmation of that.»

«We discussed the content of the proposed amendments in detail just the other day at parliamentary hearings dedicated to this topic. Among the changes, there are conceptual amendments that also play a significant role in specifying the conceptual apparatus of the Charter and the procedure for law-making by the administration of Krasnodar Krai. At the moment, no comments have been received on the draft. If there are no more, the law is planned to be adopted in the second reading at the next February session,» commented Yuri Burlachko.
