On a regular city street, a black sedan brakes sharply in front of the car from which the video is being recorded. No collision occurs, the cars change lanes, but then the black car brakes sharply again. It all ends in an accident — watch the video.

Probably, before this road situation, the drivers had some conflict, as a result of which one decided to teach the other a lesson. Standard accident analysis practice assumes that in such cases, the driver who was behind and crashed into the vehicle in front is to blame.

However, if there is video footage that shows the true state of affairs in the accident situation, courts may make different decisions about guilt.

— Undoubtedly, the driver of the black sedan is to blame; his driving can be classified as dangerous. The cause of the accident was the driver«s violation of clause 8.4 of the Traffic Rules — he did not yield the road when changing lanes, which provoked the accident, — says lawyer Vladimir Aleshin.

— With such video, the «teacher» is 100 percent to blame. Clauses 1.5, 2.7 of the Traffic Rules. Dangerous driving, expressed in the repeated commission of one or several consecutive actions, consisting of failure to yield the road when changing lanes, — says Denis Sadovsky, lawyer at the company «Inyurkon».

Clause 8.4 of the Traffic Rules. When changing lanes, the driver must yield to vehicles moving in the same direction without changing their course.

1.5. Road users must act in such a way as not to create danger to traffic and not cause harm.

2.7. The driver is prohibited from dangerous driving.

Of course, on the road, it«s better to avoid disputes that can lead to such methods of »teaching«. If you see that someone is cutting you off or braking sharply, — try not to argue, but fall back from such a car, reduce speed, keep your distance.

And of course, it makes sense to install a stationary dash cam in the car that records the road situation. This will help you in an unpleasant situation to defend your case in court, prove violations by the opponent.
